From Standard Times Press News Paper IN THE COURTROOM A consumer, Mr. Augustine Kpaka who has championed the court action is the latest victim of the recent alleged contaminated Brewery negligence. He was treated by Sierra Leone’s Pathologist, Dr. Owizz Koroma for acute diarrohea problem, allegedly after consuming the product. Since Lawyer Kabbah forwarded a letter to the Sierra Leone Brewery on behalf of his client demanding the sum of Le250, 000, 000 (Two Thundred and Fifty Million Leones) as damages and compensation, the Company has done nothing to salvage the situation, instead solicitors representing the Sierra Leone Brewery Company responded in a very derogatory manner, according to Lawyer Kabbah .
The writ which was signed by the Master and Registrar of the High Court stated thus “We command you that within 14 day after the service of this writ on you, inclusive of the day of such service, you do cause an appearance to be entered for you in the High Court of Sierra Leone in an Action at the Suit of Augustine Kpaka of Freetown and take notice that in default of your so doing the Plaintiff may proceed therein, and judgment may be given in your absence”.
The Company has been commanded to appear either personally or through their solicitor in the High Court. The writ also ordered the Company to deliver a defense within ten days from the last day of the time limited for appearance. The statement of claim made by the plaintiff, Augustine Kpaka, included: Damages for Negligence, Cost, and Interest pursuit to the Law of Tort Miscellaneous Act Cap. 19 of the Laws of Sierra Leone 1960 and any further other relief the High Court that may deem fit and just.
