Lawyer Takes Bintumani Hotel Case To Appeals Court…In Defence Of Client
Posted by on Apr 7, 2008, 01:00

Lawyer Sahid Sesay of the Serry Kamal law firm would not relent in his legal battle to set his client free from what he called “unfavourable” judgment delivered by High Court Judge, Justice D.B.Edwards recently and the dismissal of his application to take a second look and re-examine the judgment. Justice D.B.Edwards in his summation said “The application is dismissed with costs such costs to be taxed”

It would be recalled that the Bintumani Hotel had sued both Clarence Peter Blankson (1st Defendant) for $22,000.00 (Twenty Two Thousand Dollars), being hotel bills for the period he was guest of the complex, but allegedly failed to honour his financial obligation.

2nd Defendant, Richard Owiredu, a Ghanaian businessman resident in Sierra Leone who stood as surety for the 1st Defendant when he was initially arrested by police officers attached to the Aberdeen Police Station is also affected by the judgment. For the 2nd Defendant who stood as surety when the 1st Defendant was initially arrested reportedly handed him over to the police when he was requested to do so. Clarence Peter Blankson was re-arrested by the Congo Cross police for failing to meet his financial obligation after several unfulfilled promises.

Representing the Bintumani Hotel is the Renner Thomas and Co. law firm. In the legal opinion of lawyer Sahid Sesay, the judgment of the Learned Judge should not affect his client, 2nd Defendant since he was not directly involved but only served as surety for a brief period and when requested by the police to hand over the suspect before charged to court, he complied without any delay. Justice D.B.Edwards had viewed his argument from a different legal point of the law.

The matter, according to lawyer Sahid Sesay will be pursued in the Appeal Court to obtain justice for his client, 2nd Defendant while his colleague, R.S.Johnson of Renner Thomas and Co. is fully prepared to challenge him when they get to the Appeal Court. The law firm of Renner Thomas and Co. is owned by the former Chief Justice, Dr. Ade Renner Thomas. The matter has not yet been slated for hearing, but meanwhile filings of legal papers are in the process.
